Terms & Conditions
By using this website, scheduling services, purchasing products or medications, or enrolling in a membership with Empowher Health & Wellness, PLLC (“Empowher”), you agree to these Terms and Conditions.
1. Medical Services
All services are provided within the provider’s professional scope and applicable law. Scheduling, payment, or membership does not guarantee that any medication, laboratory test, treatment, or referral will be prescribed or ordered. Treatment decisions are based on the provider’s independent clinical judgment.
Empowher does not provide emergency care. Call 911 or go to the nearest emergency department for urgent or life-threatening concerns.
2. Telehealth
Telehealth services are available only when the patient is physically located in a jurisdiction where the provider is authorized to practice. Telehealth may have technological and examination limitations. An in-person evaluation, urgent care, emergency care, laboratory testing, or referral may be required when telehealth is not clinically appropriate.
3. Prescriptions and Refills
Prescriptions and refills require clinical appropriateness, required monitoring, timely follow-up, and compliance with clinic policies. Requests may be denied or delayed when required visits, laboratory testing, documentation, or payment obligations are incomplete.
Controlled medications are prescribed only when clinically appropriate and permitted under current federal and Oklahoma requirements.
4. Compounded Medications
Compounded medications are prepared for an individual patient by a licensed pharmacy and are not FDA-approved. The FDA does not evaluate compounded medications for safety, effectiveness, or quality before marketing.
Empowher may collect medication payment from the patient and remit payment to the dispensing pharmacy. The pharmacy remains responsible for accepting the prescription, preparing and dispensing the medication, and shipping it directly to the patient. Medication prices and availability may change.
Medication charges may become nonrefundable once an order has been submitted to or processed by the pharmacy. Pharmacy delays, shipping issues, or product availability are not fully within Empowher’s control.
5. Memberships and Recurring Payments
Memberships require an initial six-month commitment unless otherwise stated in the signed Membership Agreement. Members remain financially responsible for six consecutive monthly payments even when services are not used. After the initial term, membership continues month-to-month until properly cancelled.
Members who pay the base six-month membership fee in full may receive a 10% discount. Prepaid membership fees are generally nonrefundable after the membership begins. The discount does not apply to specialty-management fees, medications, laboratory testing, pharmacy charges, supplements, or other separately billed services.
Revoking payment authorization does not cancel the membership or eliminate amounts already owed. Failed payments may be retried, and non-urgent services may be paused until the account is current.
6. Fees, Cancellations and Refunds
Patients are responsible for all applicable consultation, membership, specialty-management, medication, laboratory, cancellation, and no-show fees. Fees for professional services are separate from medication, pharmacy, laboratory, or third-party charges unless expressly stated otherwise.
Cancellation, refund, and notice requirements are governed by the policy or agreement applicable to the service purchased. Completed services and fees already submitted to third parties are generally nonrefundable.
7. Insurance and Third-Party Services
Unless expressly stated otherwise, Empowher’s services are self-pay. Insurance coverage, reimbursement, and prior-authorization approval are not guaranteed.
Empowher may use third parties for website hosting, scheduling, electronic health records, telehealth, payment processing, laboratory coordination, pharmacy fulfillment, shipping, and related services. Empowher is not responsible for third-party availability, pricing, processing times, policies, content, or performance.
8. Patient Responsibilities
Patients must provide complete and accurate health, medication, allergy, identity, location, insurance, and payment information. Patients are responsible for completing required testing and follow-up, reporting adverse effects, and seeking emergency care when appropriate.
Electronic communications are not intended for emergencies and cannot be guaranteed completely secure or immediately reviewed.
9. Website and Educational Information
Website content is for general educational purposes and does not replace individualized medical advice, diagnosis, or treatment. Use of the website does not establish a provider-patient relationship. A clinical relationship begins only after required registration, consent, evaluation, and provider acceptance.
10. Privacy and Intellectual Property
Personal and health information is handled according to applicable law and Empowher’s Privacy Policy and Notice of Privacy Practices. Empowher does not sell personal information.
Website text, graphics, branding, logos, forms, and educational materials are owned by or licensed to Empowher and may not be copied, reproduced, or distributed without written permission.
11. Limitation of Liability and Termination
No particular treatment result, weight change, symptom improvement, medication response, or health outcome is guaranteed. To the extent permitted by law, Empowher is not responsible for indirect losses or circumstances outside its reasonable control.
Empowher may decline or terminate non-emergency services for safety concerns, inappropriate behavior, noncompliance, unpaid balances, or when continued care is no longer clinically appropriate. When appropriate, reasonable transition guidance will be provided.
12. Changes and Governing Law
These Terms may be updated periodically. Continued use of the website or services after an update constitutes acceptance of the revised Terms. These Terms are governed by applicable federal law and the laws of the State of Oklahoma.
